Terms of Service

Please read these Terms of Service ("Terms") carefully before using the useclaw.ai website and service ("Service") operated by Pragmatic Identity sp. z o.o., a company registered in Poland (KRS: 0000922559, NIP: 9151819429, REGON: 520003533), with its registered address at ul. Piłkarska 10, 55-114 Malin, Poland ("us", "we", or "our", also referred to as "useclaw.ai"). By accessing or using the Service, you ("you" or "User") agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

useclaw.ai provides a hosted AI agent service powered by OpenClaw technology. The Service allows users to deploy AI agents that can perform tasks on their behalf, including but not limited to:

  • Sending and receiving emails through a dedicated agent email address
  • Searching the web and summarizing information
  • Processing and analyzing documents
  • Communicating via messaging platforms (e.g., Telegram)
  • Other tasks as the Service evolves

The Service includes security features such as agent isolation, input screening, and data leak prevention. Some of these features may be designated as "Beta" or "Coming soon" and are subject to additional terms described in Section 7 below.

2. Account Registration

To use the Service, you must create an account using a supported authentication method (currently Google Sign-In or Apple Sign-In via Clerk). You must be at least 18 years old to create an account. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account, including all actions taken by your AI agent
  • Notifying us immediately of any unauthorized use of your account

3. Acceptable Use

You agree NOT to use the Service to:

  • Send spam, unsolicited emails, bulk messages, or any communication that violates the CAN-SPAM Act, GDPR, or other applicable anti-spam and electronic communication laws
  • Harass, abuse, threaten, or harm any person
  • Violate any applicable local, state, national, or international law or regulation
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity
  • Send deceptive, misleading, or fraudulent communications through your agent
  • Interfere with, disrupt, or overburden the Service or its infrastructure
  • Attempt to gain unauthorized access to any systems, accounts, or data
  • Transmit malware, viruses, or other malicious code
  • Use the Service to process, store, or transmit content that infringes on the intellectual property rights of others
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Resell, sublicense, or provide the Service to third parties without our written consent

We reserve the right to suspend or terminate your account if we reasonably determine that you have violated these restrictions.

4. AI Agent — Inherent Risks and Limitations

AI is an emerging and inherently unpredictable technology. By using the Service, you acknowledge and accept the following risks:

  • AI agents are unpredictable. Your agent is powered by artificial intelligence — a technology that is fundamentally probabilistic and non-deterministic. AI agents can and will produce inaccurate, incomplete, inappropriate, or misleading outputs. They may take unintended actions, misinterpret instructions, fabricate information, or behave in unexpected ways. These are not bugs — they are inherent characteristics of the technology in its current state.
  • You use the Service at your own risk. You are solely responsible for any consequences arising from your agent's actions, including emails sent, information processed, and decisions made. useclaw.ai is not responsible for any harm, loss, embarrassment, or damage caused by your agent's outputs or actions, whether expected or unexpected.
  • You are the sender. All emails and communications sent by your agent are legally sent by you. You are the sender for purposes of CAN-SPAM, GDPR, and all other applicable laws governing electronic communications. You are solely responsible for the content, accuracy, and recipients of all agent-sent communications.
  • You must supervise your agent. You are responsible for reviewing, monitoring, and approving the actions your agent takes. You should not rely on the agent for high-stakes, irreversible, financial, medical, legal, or safety-critical decisions without independent human verification.
  • AI providers process your data. To provide the Service, your agent's inputs and outputs are processed by third-party AI model providers. We do not control and are not responsible for how these providers process data beyond our contractual agreements with them. See our Privacy Policy for details.

Security Features — No Guarantees

We implement security measures including agent isolation, input screening, and data leak prevention. These features are best-effort risk reduction measures, not guarantees. You acknowledge that:

  • No security system is infallible. Our security features reduce risk but cannot prevent all security incidents, data exposure, or agent misbehavior.
  • Known techniques exist to bypass, circumvent, or trick AI security guardrails, including prompt injection, jailbreaking, and other adversarial methods. New techniques are discovered regularly. We cannot guarantee protection against all known or unknown attack vectors.
  • Features labeled "Beta" or "Coming soon" are experimental and may have significant limitations. See Section 7.
  • Security in AI systems is an active area of research with no solved solutions. The state of the art is evolving, and current defenses have known limitations that are publicly documented.

Assumption of Risk

BY USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL RISKS ASSOCIATED WITH THE USE OF AI AGENTS, INCLUDING BUT NOT LIMITED TO: RISKS OF INACCURATE OR HARMFUL OUTPUTS, UNINTENDED AGENT ACTIONS, FAILURE OF SECURITY MEASURES, DATA EXPOSURE DESPITE SAFEGUARDS, AND ANY OTHER RISKS INHERENT TO AI TECHNOLOGY IN ITS CURRENT STATE OF DEVELOPMENT. YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK. USECLAW.AI'S LIABILITY FOR THESE INHERENT RISKS IS LIMITED AS SET FORTH IN SECTION 10.

5. Fees, Subscriptions, and Payment

Subscription

The Service is offered on a monthly subscription basis. By subscribing, you authorize us to charge your payment method on a recurring monthly basis at the then-current rate until you cancel. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.

Payment Processing

Payments are processed through Apple's In-App Purchase system or other payment platforms as applicable. Payment processing, retry logic, and billing disputes are governed by the payment platform's terms. If payment cannot be collected, we may suspend your access to the Service, including deactivating your agent, until the outstanding balance is resolved.

Cancellation

You may cancel your subscription at any time through your device's subscription settings (e.g., iOS Settings → Subscriptions) or by contacting us. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the period you have already paid for.

Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the right to withdraw from your subscription within 14 days of purchase without giving any reason, in accordance with the EU Consumer Rights Directive. However, by subscribing and using the Service, you expressly request that we begin providing the Service immediately and you acknowledge that you lose your right of withdrawal once the Service has been fully performed or, for ongoing services, once you have started using the Service during the withdrawal period. Refunds

Subject to your right of withdrawal above, subscription fees are generally non-refundable except where required by applicable law. Refunds for purchases made through Apple's In-App Purchase system are handled by Apple in accordance with their refund policies. We may, at our sole discretion, offer credits on a case-by-case basis.

Price Changes

We reserve the right to change our pricing. We will provide at least 30 days' notice before any price increase takes effect. If you do not agree to the new pricing, you may cancel your subscription before it renews at the new rate.

6. User Content and Data

You retain ownership of all content you submit to or create through the Service ("User Content"), including emails, documents, and other data processed by your agent.

By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, process, store, and transmit your User Content solely as necessary to:

  • Operate and provide the Service, including sending emails and messages on your behalf
  • Transmit your content to third-party AI model providers for processing
  • Apply security measures such as input screening and data leak prevention
  • Comply with applicable law or respond to valid legal process

We do not use your User Content to train AI models, for advertising, or for any purpose other than providing the Service to you.

7. Beta Features

Certain features of the Service may be designated as "Beta," "Preview," "Coming soon," or similar labels. These features are provided for evaluation purposes and:

  • May be incomplete, contain bugs, or not function as described
  • May be changed, suspended, or removed at any time without notice
  • Are provided "AS IS" without any warranty or service level commitment
  • Should not be relied upon for critical or sensitive operations

8. Intellectual Property

The Service — including its software, design, branding, documentation, and all associated intellectual property — is owned by useclaw.ai and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.

The underlying OpenClaw technology is open-source software governed by its own license. Our hosted service, security features, infrastructure, and branding are proprietary to useclaw.ai.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE EXPRESSLY DISCLAIM ANY WARRANTY OR REPRESENTATION THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • AI AGENT OUTPUTS WILL BE ACCURATE, COMPLETE, RELIABLE, APPROPRIATE, OR FREE FROM BIAS OR HARMFUL CONTENT
  • YOUR AI AGENT WILL BEHAVE AS INTENDED OR FOLLOW YOUR INSTRUCTIONS CORRECTLY IN ALL CASES
  • SECURITY FEATURES (INCLUDING ISOLATION, INPUT SCREENING, AND DATA LEAK PREVENTION) WILL PREVENT ALL SECURITY INCIDENTS, PROMPT INJECTION ATTACKS, DATA EXPOSURE, OR UNAUTHORIZED AGENT ACTIONS
  • EMAILS OR COMMUNICATIONS SENT BY YOUR AGENT WILL BE DELIVERED SUCCESSFULLY, WILL NOT BE FLAGGED AS SPAM, OR WILL BE FREE FROM ERRORS OR UNINTENDED CONTENT
  • THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS
  • THE SERVICE WILL BE COMPATIBLE WITH OR NOT DISRUPT ANY OTHER SYSTEMS OR SERVICES

ANY DESCRIPTIONS OF SECURITY FEATURES, CAPABILITIES, OR PROTECTIONS ON OUR WEBSITE, MARKETING MATERIALS, OR DOCUMENTATION ARE DESCRIPTIONS OF OUR GOALS AND DESIGN INTENT — NOT WARRANTIES, GUARANTEES, OR PROMISES OF PERFORMANCE. THE INHERENT UNPREDICTABILITY OF AI TECHNOLOGY MEANS THAT NO SECURITY MEASURE CAN BE GUARANTEED TO WORK IN ALL CIRCUMSTANCES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

(A) USECLAW.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR REPUTATION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER USECLAW.AI WAS ADVISED OF THE POSSIBILITY THEREOF.

(B) USECLAW.AI'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO USECLAW.AI IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

(C) WITHOUT LIMITING THE ABOVE, USECLAW.AI SHALL NOT BE LIABLE FOR ANY DAMAGE, LOSS, OR INJURY ARISING FROM: (I) ACTIONS TAKEN BY YOUR AI AGENT, INCLUDING EMAILS SENT, DATA PROCESSED, OR DECISIONS MADE, WHETHER INTENDED OR UNINTENDED; (II) INACCURATE, INCOMPLETE, MISLEADING, BIASED, OR HARMFUL AGENT OUTPUTS; (III) FAILURE OF SECURITY FEATURES TO PREVENT ANY SPECIFIC ATTACK, DATA LEAK, OR UNAUTHORIZED AGENT ACTION; (IV) UNAUTHORIZED ACCESS TO YOUR ACCOUNT DUE TO YOUR FAILURE TO MAINTAIN ACCOUNT SECURITY; (V) ACTIONS OR FAILURES OF THIRD-PARTY SERVICE PROVIDERS, INCLUDING AI MODEL PROVIDERS; (VI) ANY CONSEQUENCES OF RELYING ON AI-GENERATED CONTENT OR AGENT ACTIONS WITHOUT INDEPENDENT HUMAN VERIFICATION; OR (VII) ANY INHERENT RISK OF AI TECHNOLOGY AS DESCRIBED IN SECTION 4 OF THESE TERMS.

(D) NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY FOR: (I) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE; (II) FRAUD OR FRAUDULENT MISREPRESENTATION; (III) INTENTIONAL MISCONDUCT (WINA UMYŚLNA); OR (IV) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING MANDATORY CONSUMER PROTECTION LAWS.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless useclaw.ai and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms or any applicable law or regulation
  • Your use of the Service in a manner not authorized by these Terms
  • Any claim by a third party arising from communications sent by your agent that violate applicable law (including anti-spam laws)
  • Your User Content that infringes the rights of a third party

This indemnification obligation does not apply to the extent that a claim arises from our own negligence, intentional misconduct, or breach of these Terms. If you are a consumer in the European Union, this section applies only to the extent permitted by mandatory consumer protection laws in your country of residence.

12. Dispute Resolution

Informal Resolution

Before filing any formal proceeding, you agree to first contact us at support@useclaw.ai and attempt to resolve the dispute informally for at least 30 days.

Mediation

If we cannot resolve a dispute informally, either party may propose mediation. Mediation shall be conducted in English under the mediation rules of the Court of Arbitration at the Polish Chamber of Commerce (SA KIG) in Warsaw, Poland, or remotely by agreement of the parties. The costs of mediation shall be shared equally unless the mediator recommends otherwise.

Jurisdiction

If a dispute cannot be resolved through informal resolution or mediation, it shall be submitted to the exclusive jurisdiction of the courts competent for the registered seat of Pragmatic Identity sp. z o.o., except where mandatory consumer protection laws in your country of residence grant you the right to bring proceedings in your local courts.

EU Consumer Rights

If you are a consumer residing in the European Union, nothing in these Terms limits your rights under mandatory consumer protection laws of your country of residence, including your right to bring proceedings in your local courts. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Termination

By You

You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion.

By Us

We may suspend or terminate your account immediately, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive activity, or if required by law. We may also terminate the Service entirely with 30 days' notice.

Effect of Termination

Upon termination, your right to use the Service ceases immediately. Your agent will stop operating and its dedicated email address will be deactivated. Any emails sent to your agent's address after deactivation will be bounced (returned to sender) and will not be stored or forwarded. We will retain your account data for 30 days following termination, during which time you may request an export of your data by contacting us. After 30 days, we will delete your data in accordance with our Privacy Policy, unless retention is required by law.

Survival

The following sections survive termination of these Terms: Section 4 (AI Agent — Inherent Risks and Limitations), Section 6 (User Content and Data), Section 9 (Disclaimer of Warranties), Section 10 (Limitation of Liability), Section 11 (Indemnification), Section 12 (Dispute Resolution), Section 14 (Force Majeure), Section 16 (Governing Law), Section 17 (Severability), and Section 18 (Entire Agreement).

14. Force Majeure

useclaw.ai shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, government actions, power or internet outages, failures of third-party service providers (including AI model providers, cloud infrastructure, and payment processors), cyberattacks, or labor disputes.

15. Changes to Terms

We may modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email or a prominent notice within the Service before the changes take effect. If you do not agree to the updated Terms, you have the right to terminate your subscription and stop using the Service before the changes take effect, without penalty. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of those changes.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland. If you are a consumer residing in the European Union or the United Kingdom, you will also benefit from any mandatory provisions of the consumer protection laws of your country of residence.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and useclaw.ai regarding the Service and supersede all prior agreements or understandings.
